General Terms & Conditions

ARTICLE 1: 

Any reservation made with Century Driver implies unreserved acceptance of these general conditions of sale.

ARTICLE 2 – RESERVATIONS

2.1– Online booking 

Reservations can be made on our dedicated page https://century-driver.com/reservation/ , by phone at +33 6 45 62 29 08 or directly by email at contact@century-driver.com . An email confirming our availability will then be sent by our services.

Regardless of the type of reservation, the customer must provide the following mandatory information:

Customer information: first and last name, telephone number, email address and residential address.
Trip details: Date, departure and arrival point for transfers, desired duration of the transfers, number of people, luggage or not, luggage with exceptional dimensions or very large volumes, child/baby seat required.
This information must be specified online when making the reservation request.

Century Driver strives to ensure the availability of the Site 24 hours a day, 7 days a week. However, access to the Site may be interrupted for maintenance operations, hardware or software upgrades, emergency repairs to the Site, or as a result of circumstances beyond the control of Century Driver (such as failure of telecommunications links and equipment). Century Driver undertakes to take all reasonable measures to limit these disruptions, insofar as they are attributable to it.
Users acknowledge and accept that Century Driver assumes no liability towards them for any unavailability, suspension or interruption of the Site or the service and cannot be held liable for direct or indirect damages of any nature resulting from this fact.

In accordance with these T&Cs, the Customer acknowledges that the Services to which he/she has subscribed are available immediately and cannot therefore, and in accordance with Article L.221-18 of the Consumer Code, be subject to the right of withdrawal.

The Client’s obligations, as well as those of Century Driver , may be suspended in the event of force majeure in accordance with these T&Cs.

The payment confirmation email received when paying for the ordered trip constitutes the only definitive confirmation of the reservation and guarantees the presence of the driver.

2.2– Reservation by telephone 

The reservation must be made at least 1 hour before departure and during reservation hours.

For any reservation made within this time limit, the company reserves the right to a delay of 30 minutes in arriving at the departure point.

ARTICLE 3 – SERVICE

The service is only valid once.

The service begins at the customer’s pick-up location, on the day and time specified in the contract previously established between the parties. It ends on the day and time of the customer’s drop-off.

In the event of a customer delay, the driver will wait:

* 60 minutes free of charge from the meeting time set by the customer when booking for airport trips.
* 15 minutes free of charge from the meeting time set by the customer when booking for train station and other trips.

After this time, Century Driver will consider the service canceled.
If the customer wishes, the driver will wait beyond the free waiting time and will be charged €1.50/min for waiting fees.

If it turns out that the client is not present at the meeting place, the service will be definitively lost, due by the client and will not give any right to reimbursement.

If the customer cannot find the driver, they must call Century Driver immediately to avoid being charged the full amount of the service.

Respect and proper use of the equipment is essential. Any deterioration of the equipment or any damage caused to the interior of the vehicle will be the responsibility of the customer and will be billed to them.

Smoking is strictly prohibited inside the vehicle.

Eating in vehicles is prohibited.

Wearing a seat belt is mandatory in both the front and rear of the vehicle.

Animals are not allowed in vehicles, except in a cage or bag provided for this purpose.

Century Driver is not responsible for any items left in vehicles or elsewhere during the service.

Under no circumstances may the customer require the driver to exceed the authorized speed limit or commit any traffic violations.

More generally, the driver reserves the right to refuse any instructions and/or requests from the customer that he considers likely to compromise the safety of the vehicle’s occupants and other road users.

Our drivers are true professionals, and their responsibility is engaged; they are instructed to respect and enforce the laws in force.

Century Driver reserves the right to immediately terminate any service if the customer engages in behavior that endangers the safety of the driver, the vehicle, or other road users. The service will then be billed in full to the customer.

Customers who are excessively intoxicated or who insult the driver will not be permitted to board the vehicles under any circumstances. The service will then be billed in full to the customer.

The volume of luggage transported is proportional to the vehicle’s capacity. It remains the responsibility of the passengers transported throughout the service.

In the event of damage to the vehicle by the customer (including vomiting), the customer will be held responsible and will have to pay a fixed compensation of €250.

Any modification of the route by the customer or by their client may result in additional charges which will be invoiced to them.

The service provided by Century Driver , as regulated by Articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the Tourism Code, consists of providing the customer with a vehicle, inseparably accompanied by the services of a driver. The following are included in the service:

  • the vehicle made available to the customer;
  • the provision of a driver who speaks at least French;
  • professional insurance for passengers transported for payment, kilometers traveled, vehicle maintenance, fuel and the duration determined when booking the service
  • the transport of the customer’s luggage, within the limits of the vehicle’s capabilities.
  • the cost of tolls

Not included in the Service:

  • the cost of parking and more generally of all parking places;
  • entrance fees to sites (museums, theaters, castles, stadiums or others);
  • entrance fees to public places;

ARTICLE 4 – PRICE

Our rates are inclusive of VAT and are expressed in Euros (€). The applicable VAT rate for transfers is 10%. The applicable VAT rate for hourly availability is 20%.

The transfer rate applies to direct travel, without stops or stages, from the pick-up point to the arrival point previously established in the contract.

Prices are per vehicle, regardless of the number of people transported.

For the provision, any hour started is due.

All routes booked by our customers are calculated using Google Maps, which is our sole reference and determines the final fare. Trips are calculated based on the route with the fastest estimated travel time.

The driver is free to change the route depending on traffic conditions without the price being affected for the customer.

The Century Driver reservation system takes into account journey times that are based on daily observation of local traffic.

Century Driver cannot be held responsible for traffic conditions that may result in a longer travel time than the one estimated at the time of the initial reservation. It is the customer’s responsibility to allow for the necessary travel time when booking. Generally, Century Driver cannot be held responsible for delays, regardless of their origin (traffic congestion, difficult driving conditions, roadworks, accidents, vehicle breakdown, etc.), in accordance with Article 7 of these general terms and conditions of sale.

When the customer orders a trip from the airport, it is particularly recommended that, when making their reservation, they take into account the time required to get off the plane and to collect their baggage before determining the departure time of the trip.

Our rates include:

  • VAT
  • the vehicle made available to the customer;
  • the provision of a driver who speaks at least French;
  • professional insurance for passengers transported for payment, kilometers traveled, vehicle maintenance, fuel and the duration determined when booking the service
  • the transport of the customer’s luggage, within the limits of the vehicle’s capabilities.
  • the provision on board service vehicles (WIFI, cold drinks, phone chargers, touchscreen tablets)
  • the cost of tolls.

Our rates do not include:

  • the cost of parking and more generally of all parking places;
  • entrance fees to sites (museums, theaters, castles, stadiums or others);
  • entrance fees to public places;
  • the driver’s meal and accommodation costs for a trip lasting several days.

ARTICLE 5 – REGULATIONS

Our services are payable in cash, in euros, online, or on board the vehicle, when the customer is picked up.

We accept payment by:

– Credit card, Cash or PayPal.

– By transfer for companies.

No discount is granted for payment on a date prior to the service.

In all cases, the customer signing the reservation is solely responsible for payment of the service in the event of user default.

Any additional service, any excess mileage or duration, will be invoiced in accordance with the price indicated on the order form.

Any hour started is due in full.

Online payment is made by credit card via a secure electronic payment system, STRIPE. By providing their bank details, the Customer accepts in advance and unconditionally that Century Driver will carry out the secure transaction and authorizes their bank in advance to debit their account for the amount of the service and any additional charges after the trip (waiting, parking, additional stops, change of destination address) if applicable.

The Customer may, if they wish, register their credit card for all Orders. If the Customer does not wish to register their credit card for all Orders, they must register their credit card information for each Order.

By providing their bank details, the Customer agrees that the Company may proceed with the secure transaction when they finalize an Order. The Customer therefore authorizes their bank to debit their account upon finalizing an Order based on the records or statements sent by the Company.

The reservation will only be deemed accepted after payment has been validated.

ARTICLE 6 – CANCELLATION

Any cancellation of a reservation less than 24 hours before the start of the service will be considered due and invoiced to the customer.

ARTICLE 7 – LIMITS OF LIABILITY

Century Driver cannot be held responsible for delays in rail or air traffic.

Century Driver undertakes to do everything possible to transport the traveler safely to their destination, within the time agreed with them.

Century Driver cannot be held responsible for any delays due to road traffic beyond its control: road closures, bridges closed to traffic, traffic jams, flooded roads, demonstrations, weather conditions, interventions by police, firefighters or customs, etc. (non-exhaustive list).

Century Driver cannot under any circumstances be held responsible for delays directly resulting from an initial delay by the customer, or from the need to make a journey, at the customer’s request, within a timeframe that is clearly too short.

In the event of immobilization of the vehicle due to mechanical failure, accident or damage (theft, damage), Century Driver will endeavor to ensure the continuity of the journey, either with one of its vehicles or with a vehicle chartered from another company and undertakes to notify the principal.

ARTICLE 8 – INSURANCE

Century Driver ‘s liability is limited to the terms of our insurance contract.

Our vehicles are insured for passenger transport, and our passengers are covered for all bodily injury by our insurer. This insurance also covers professional civil liability, in accordance with current French regulations, pursuant to Article L. 3120-4 of the French Transport Code.

The client will have the right to take out additional insurance at his own expense covering cancellation costs, repatriation costs or transported baggage.

ARTICLE 9 – PERSONAL DATA

Century Driver is committed to respecting the privacy of its customers.

Century Driver is committed to respecting the confidentiality of personal data collected on its website in accordance with the French Data Protection Act No. 78-17 of 6 January 1978. As such, Century Driver undertakes not to disclose to third parties the information communicated by the customer on its website and to use it only for processing their reservation. The customer may exercise a right of access to their file and a right to rectify or delete information concerning them by sending their request to Century Driver Customer Service .

ARTICLE 10 – DISPUTES

These general conditions of sale are governed exclusively by French law.

Any claim must be notified in writing by registered letter to Customer Service within a maximum of 8 days. After this period, no claim will be accepted.

Subject to legal provisions, any dispute is, by express agreement, under the exclusive jurisdiction of the Commercial Court of Paris.

The consumer may bring proceedings before either one of the courts with territorial jurisdiction under the Code of Civil Procedure or the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.

When Century Driver ‘s liability is incurred as a result of a fault on its part, compensation only applies to direct, personal and certain damages suffered by the customer, to the express exclusion of compensation for all indirect and immaterial damages and/or losses, such as financial and commercial losses.

 

ARTICLE 11 – ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE  

 

The customer acknowledges having read the general conditions of sale when making their reservation.

Acceptance of a quote by the customer and confirmation of their order imply the customer’s full acceptance of these general terms and conditions of sale and unreserved acceptance of all the provisions set out therein.

Century Driver reserves the right to modify them at any time.

In the event that any of the provisions of these General Conditions of Sale are declared null or deemed unwritten, all other provisions shall remain applicable.
